Terms of Service

§1 General Provisions

1. This document sets out the rules and conditions for using the CWMiP website available at www.cwmip.pl.

2. The website is owned by CWMiP Chimiak, Witkowska, Muczkowska, Pilecka sp.j., located at Rondo Ignacego Daszyńskiego 2B, 00-843 Warsaw, registered in the National Court Register under number KRS: 0001111241, NIP: 5273117117.

3. To use the service, the user must read these Terms of Service and the Privacy Policy. Using the website constitutes acceptance of both documents.

4. Terms used in this document are defined as follows:
a. Platform – the online platform operated by the Service Provider in Polish at www.cwmip.pl,
b. Service Provider – CWMiP Chimiak, Witkowska, Muczkowska, Pilecka sp.j.,
c. Website – the website located at www.cwmip.pl,
d. User / Client – a natural person (with full legal capacity), legal person, or organizational unit without legal personality who uses the Platform. A User may be both a private individual and an entrepreneur,
e. Consumer – within the meaning of the Polish Civil Code (Act of 23 April 1964), a User who, as a natural person, performs a legal action via the Platform not directly related to their business or professional activity,
f. Terms of Service – this document together with the Privacy Policy, which forms an integral part. All documents are available on the Website.

§2 Services Provided via the Platform

1. The Service Provider provides electronic services to Users via the Platform.

2. No fees are charged to Users for these electronic services.

3. The core of the Services is providing internet access to the Platform. Services include:
a. Contact form.

§3 General Rules for Using the Platform

1.To use the Services on the Website or mobile devices, Users must meet the following technical requirements:
a. Have a computer, laptop, smartphone, or other device with internet access,
b. Have access to email,
c. Use an internet browser (Mozilla Firefox, Google Chrome, Safari, Internet Explorer, Microsoft Edge, Chrome, Firefox, Opera, Android, Safari (iOS), Windows Phone, Blackberry – latest versions),
d. Enable cookies in the browser,
e. Enable JavaScript support.

2. Users must act in accordance with applicable laws and good practices.

3. It is forbidden to use the Platform in any way that harms other Users, the Service Provider, or third parties.

4. Every User agrees to:
a. Use the Platform’s features and resources according to its purpose,
b. Comply with Polish law,
c. Respect the rights and personal interests of other Users,
d. Avoid causing harm to other Users, the Service Provider, or third parties.

§4 Liability – Access and Use of the Platform

1.The Service Provider will make every effort to ensure proper, safe, uninterrupted, and error-free access to the Platform.

2. The Service Provider reserves the right to make changes to the Services and Platform as part of improvements and modernization, including changes to functionalities.

§5 Liability for Compliance with the Agreement – Complaints Procedure

1.The Service Provider is obliged to provide defect-free services in accordance with the agreement.

2. The Service Provider’s liability toward Consumers is regulated by Chapter 5b of the Polish Consumer Rights Act of 30 May 2014.

3. Consumers may file complaints under this Act, particularly in case of non-compliance of services with the agreement.

4. A digital content or service is considered compliant if, in particular, its description, type, quantity, quality, functionality, compatibility, and availability match the agreement.

5. Furthermore, digital content or services must:
a. Be fit for usual purposes and comply with laws, technical norms, or good practices,
b. Have the functionality, compatibility, availability, continuity, and security expected of such content/services,
c. Be delivered with any accessories or instructions a Consumer may reasonably expect,
d. Match any preview or trial version provided before the agreement.

6. The Service Provider is liable for non-compliance revealed during continuous provision of services.

7. The Service Provider is liable for defects existing at the time of delivery and revealed within two years.

8. The Service Provider will acknowledge receipt of complaints.

9. If a complaint is rejected, the Service Provider will explain the reason.

10. If no response is provided within 14 calendar days, the complaint is considered accepted.

11. The Consumer must cooperate with the Service Provider in reasonable ways to determine if the non-compliance results from the Consumer’s digital environment.

12. Non-consumers may exercise warranty rights under Articles 556 et seq. of the Polish Civil Code.

13. The Service Provider is liable under warranty if a defect is found within two years of service delivery.

14. Non-consumer Clients lose warranty rights if they fail to examine and notify defects in time.

15. Any Service malfunctions may be reported within 14 days to cwmip@cwmip.pl with sufficient details.

15. Any issues, errors, or violations of the Terms should be reported electronically.

§6 Service Changes

1.For contracts with Consumers not acting as entrepreneurs, the Service Provider may modify digital content/services not essential for compliance with the agreement due to technical/organizational reasons.

2. One-time digital content/services cannot be changed.

3. Such changes will not involve additional costs for the Consumer.

4. The Service Provider must inform the Consumer clearly and in advance of any material changes and the right to terminate the contract.

5. The Consumer may terminate the contract within 30 days of the change or notice, whichever is later.

6. This right does not apply if the Service Provider enables the Consumer to retain unchanged, compliant services at no additional cost.

§7 Updates

1.The Service Provider informs the Consumer about updates (including security updates) necessary for compliance with the agreement. The Consumer should install them within a reasonable time.

2. The Service Provider is not liable for non-compliance resulting from the lack of updates if:
a. The Consumer was informed about the update and consequences of not installing it,
b. The failure to install was not due to faulty instructions.

§8 Intellectual Property Rights

1.All materials, including graphic elements, layout, trademarks, and other content on the Platform and Website, are the exclusive property of the Service Provider and protected by applicable laws.

2. Downloading or using materials from the Platform requires prior written consent and must not violate the Terms or applicable law.

3. Modifying or copying website or platform elements is prohibited.

4. Creating similar or identical websites or apps that may mislead users or suggest affiliation with the Service Provider constitutes an act of unfair competition.

§9 Final Provisions

1. In matters not covered by these Terms, the provisions of Polish law shall apply.
2. Any disputes arising between the Service Provider and a User shall be governed by Polish law and fall under the jurisdiction of Polish courts. For Users who are not Consumers, the court of jurisdiction is the court having jurisdiction over the Service Provider’s registered office. For Consumers, the competent court is the court of the Consumer’s place of residence.
3. These Terms of Service are effective as of 18 April 2025.
